These Terms of Service ("Terms") govern your access to and use of ClaimOps' software, services, and websites (collectively, the "Service"). By using the Service, you agree to these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
ClaimOps is software that helps restoration and roofing contractors compare contractor and carrier estimates, surface missed scope, and build supplement packages. The Service includes AI-assisted estimate parsing, supplement letter generation, carrier playbook intelligence, and recovery tracking.
3. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@claimops.io if you suspect unauthorized access. You must provide accurate and current information when registering.
4. Subscription & Payment
The Service is offered on a monthly subscription basis. Subscription fees are billed in advance and are non-refundable except where required by law. We may change pricing with at least 30 days' written notice; pricing changes do not apply to founder-tier subscribers whose pricing is locked at signup. Subscriptions renew automatically until cancelled.
5. Acceptable Use
You agree not to (a) reverse engineer or attempt to extract source code from the Service, (b) upload content that infringes third-party rights or violates law, (c) use the Service to transmit malware or attempt to breach security, (d) circumvent rate limits or use automated means to access the Service except via our public API, or (e) resell or sublicense the Service without written permission.
Fair Use of AI Features. Subscription plans include access to AI-assisted features (estimate parsing, narrative generation, evidence matching, and related tools). This access is provided for typical contractor use — processing claims in the ordinary course of your business. You agree not to use automated scripts, bots, or programmatic access to generate bulk AI requests beyond normal business use. We reserve the right to rate-limit or suspend accounts exhibiting usage patterns that are inconsistent with individual business use. We will contact you before taking any such action.
6. Intellectual Property
ClaimOps and our licensors retain all right, title, and interest in the Service, including all software, designs, trademarks, and documentation. You retain ownership of all content you upload (estimates, photos, claim data). You grant us a limited license to process your content for the sole purpose of providing the Service to you.
7. Data & Privacy
Our handling of your data is governed by our Privacy Policy, which is incorporated by reference into these Terms. You are responsible for ensuring that the data you upload to the Service can lawfully be processed by us on your behalf.
8. AI-Generated Content Disclaimer
Supplement narratives, line-item suggestions, and other outputs generated by ClaimOps are AI-assisted drafts intended to support — not replace — your professional judgment. You are responsible for reviewing, correcting, and approving all AI-generated content before submitting it to a carrier or any third party. ClaimOps does not guarantee approval of any claim or supplement; we provide tools that help you build and present a stronger supplement package. AI outputs may contain errors, omissions, or inaccuracies.
9. Limitation of Liability
To the maximum extent permitted by law, ClaimOps and its officers, directors, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of or related to your use of the Service. Our aggregate liability for any claim arising under these Terms shall not exceed the amount you paid to ClaimOps in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless ClaimOps and its affiliates from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms, (b) content you upload to the Service, or (c) your violation of any law or third-party right.
11. Termination
You may cancel your subscription at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms or fail to pay fees when due. Upon termination, your right to use the Service ends and we may delete your data subject to the retention windows described in our Privacy Policy.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction there.
13. Changes to Terms
We may update these Terms from time to time. If a change is material, we will notify you by email or through the Service at least 30 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
